Investigation & Compliance

Today, good business management requires that enterprises becoming subject to criticism or discovering possible involvement in dubious activities show the will and ability to clarify the situation and, if necessary, rectify it and ensure that similar activities will not take place in the future. This is necessary to prevent further damage to reputation and, if possible, restore people's trust in the enterprise. An external investigation is often appropriate for enterprises ending up in this situation, and we see it carried out to an increasing extent.

A successful investigation requires expertise on several levels. It can be challenging to clarify complex factual circumstances, and there are legal rules to follow in an investigation process. One must also be familiar with the increasingly stricter standards in terms of corruption, trading in influence, financial crime and receipt of stolen goods. It is essential that the investigation inspires confidence, especially from the relevant public authorities such as "The Norwegian National Authority for Investigation and Prosecution of Economic and Environmental Crime" (ØKOKRIM). The enterprise subject to criticism depends on the reliability of the investigation to avoid any further loss of reputation. Also, an investigation of potentially dubious activities may create tension in the enterprise and be a burden to the individuals involved. For a successful investigation, such tension and burdens should be avoided as far as possible. It is crucial that the investigation process is carried out with a method creating safety and trust, both internally and towards the relevant public authorities and the public in general.

Wiersholm has been involved in the largest and most prominent investigations carried out in Norway, and possesses leading expertise on the area. On the international level, we have a unique experience with issues related to the far-reaching US anti-corruption rules, FCPA - Foreign Corrupt Practices Act. Our experience gives us a special understanding of the issues at stake and knowledge of the practical aspects of the investigation processes. Wiersholm cooperates with leading IT and audit firms in connection with investigations.

Often, the enterprise finds itself in a crisis situation where exposure in the media and possible scrutiny by public authorities necessitate action. Experience, understanding of the problem and the ability to identify solutions make us able to contribute to stabilising the crisis and to start the work restoring the faith in the enterprise. Wiersholm has substantial knowledge of this type of crisis management.

Our experience both in dealing with the parties involved and in confidence-inspiring cooperation with relevant public authorities makes us prepared to take on investigation assignments and carry them out with the best possible result.
